BEFORE: MERRITT and JONES, Circuit Judges and HOLSCHUH, District Judge* Per Curiam. This is an appeal from a judgment of the district court denying petitioner's request for a writ of habeas corpus. We reverse the judgment of the district court and order that the writ of habeas corpus be granted. Petitioner, Clyde C. Wilson was convicted of bank robbery in 1972 and was sentenced to a ten year federal prison term. He was transferred to a Detroit community treatment center in 1975 while awaiting parole. During the time that petitioner was assigned to the community treatment center, he was arrested by local police for assault with intent to do serious bodily harm and placed in jail. After pleading guilty to the assault charge, petitioner was sentenced by state Judge Boyle to six and one half to ten years in prison. Judge Boyle recommended that the state sentence run concurrently with the original federal sentence imposed in 1972. Petitioner was then incarcerated in a state prison.
